WalkSpy Terms of Use

1. What WalkSpy is

WalkSpy lets walkers stream and record handheld walking tours from real streets, and lets viewers watch those walks live or later. These Terms of Use are an agreement between you and WalkSpy covering every use of the site, the mobile apps and the streaming services.

2. Accepting these terms

By creating an account, starting a walk (including an anonymous walk) or watching a stream, you agree to these terms and to our Privacy Policy. If you do not agree, please do not use WalkSpy.

3. Who may use WalkSpy

You must be at least 13 years old. If you are under the age of majority where you live, you may only use WalkSpy with a parent or guardian's permission. You are responsible for everything that happens under your account, so keep your password private.

4. Walking and streaming responsibly

When you go live you are filming real places and, unavoidably, real people. You agree to:

obey local law everywhere you walk, including filming, privacy and trespass rules;
stay on public ways or places you have permission to film;
avoid deliberately filming people in situations where they expect privacy, and stop filming anyone who asks;
never use WalkSpy to harass, stalk, dox or endanger any person;
keep your attention on your own safety. WalkSpy is not responsible for accidents that happen while you walk.

5. Your content

You keep ownership of the walks you record. By streaming or uploading through WalkSpy you grant us a worldwide, non-exclusive, royalty-free licence to host, transmit, store, transcode, display and promote that content as part of operating the service. You can delete your walks at any time, and deleting your account removes your personal data as described in the Privacy Policy.

6. Payments, subscriptions and tips

Payments on WalkSpy (subscriptions, tips, walk requests, marketplace and business features) are processed by Stripe. Prices are shown before you pay. Subscriptions renew automatically until cancelled from your Finance dashboard. Except where the law requires otherwise, payments are non-refundable once a service has been delivered. Walkers who earn money through WalkSpy are responsible for their own taxes.

7. Prohibited conduct

You may not: break the law or encourage others to; upload malware or attempt to breach our systems; scrape or resell the service; impersonate another person; post content that is sexually explicit, violent, hateful or otherwise abusive; or interfere with another user's walks or streams.

8. Enforcement

We may remove content, suspend or terminate accounts, and withhold payouts connected to a violation of these terms. Where practical we will tell you what happened and why, and you can contact us to appeal.

9. Disclaimers and liability

WalkSpy is provided "as is". We do not promise uninterrupted service, and we are not liable for the conduct of walkers, viewers or third parties. To the fullest extent permitted by law, our total liability to you for any claim is limited to the amount you paid us in the twelve months before the claim arose.

10. Changes

We may update these terms as the service evolves. If a change is material we will give notice on the site or by email before it takes effect. Continuing to use WalkSpy after a change means you accept the new terms.
